Committee responds to consultation on planning regulations

The Enterprise and Infrastructure Committee will be asked to approve the Council's response to a Scottish Government consultation on draft planning regulations when it meets on Wednesday January 30.
The response concerns draft regulations on Development Planning, Enforcement Planning Control and Planning Hierarchy arising from the new Plannning (Scotland) Act 2006.
A report to the Committee warns that the proposed regulations could lead to a more complex planning system, and that they would require significant additional resources to operate.
Committee Convener, Councillor John Kellas, said: "We welcome the opportunity to respond to these draft regulations. They contain some useful proposals, such as introducing Fixed Penatly Notices for breaching Enforcement Notices. This would avoid time-consuming court prosecutions.
"Our response also makes it clear that we have a number of concerns about some of the regulations. Certain changes could help simplify some of the new planning processes. However it is clear that they will result in more complex processes and a need for more resources. It is important that this is accepted by not only planning authorities but also by the Scottish Government."
