Bail Information
If someone is arrested and appears in court, the Procurator
Fiscal will decide whether or not to oppose bail. If bail is
opposed the Sheriff has to decide whether or not it should be
granted. Criminal Justice Social Work Services may be asked to
assess your situation for the court. If this happens we may be
asked to meet with you and to provide information to the court
regarding your personal income and any conditions that may be
attached to a bail order.
We would not normally be invited to make a bail assessment if the
Procurator Fiscal is opposing bail and:
- The current offence is very serious.
- You have a high number of outstanding cases.
- You have a record of not complying with court orders.
Wherever possible we will offer the information in the form of a
brief written report although this may be provided verbally
instead. Any written report will be provided to the Sheriff, your
solicitor and to the Procurator Fiscal.
