Diversion From Prosecution Scheme
Diversion from prosecution is an alternative way of dealing
with your Police charges. If the
Procurator Fiscal thinks that
formal criminal justice proceedings are not necessary, but you
could benefit from working with a criminal justice worker
or other agency, you might not be prosecuted at
court. This usually happens in cases involving young people or
those who are in conflict with the law for the first
time with minor offences and there is no "overriding
public interest" in taking the case to court.
The scheme aims to prevent you from committing another crime
and to tackle the underlying problems of your offending
behaviour without going through a formal court process.
In some cases, such as damage to property, you may have to
compensate the victims.
If you co-operate fully the charges will not be brought to court
and will not appear on your record.
