The Council published the notices for the South Kinross Flood Protection Scheme on 26 March 2024. Two valid objections were received in relation to the Scheme within the subsequent 28-day period. On 4 December 2024, the Council took a preliminary decision to confirm the proposed scheme without modification. Scottish Government Ministers subsequently confirmed that they did not intend to consider the Scheme and so the Council was required to hold a Local Authority Hearing.
Officers held separate discussions with both of the parties who submitted objections, however both objections were maintained. A copy of the objections, with personal information removed, is provided below. The Council have appointed an independent Reporter to consider both objections at a Local Authority Hearing. The Reporter was appointed to make a recommendation to the Council on whether the Council should:
- confirm the proposed Scheme without modification
- confirm the proposed Scheme with modifications
- reject the proposed Scheme
The Hearing session will take place virtually on Microsoft Teams, starting on 28 October 2025 at 10am and is expected to extend over two consecutive days comprising four sessions. Members of the public are welcome to attend the virtual meeting, and can be accessed by following the appropriate link below for each of the four sessions:
- Session 1: Tuesday 28 October 2025, 10am to 1pm
- Session 2: Tuesday 28 October 2025, 2pm to 4pm
- Session 3: Wednesday 29 October 2025, 10am to 1pm
- Session 4: Wednesday 29 October 2025, 2pm to 4pm
The hearing will consider the justification for the scheme and the outstanding objections.
Outcome
A further update will be provided upon conclusion of the Local Authority Hearing and subsequent receipt of the Reporter's Recommendation Report.
