Adoption of private roads

If you are responsible for an existing private road you can apply to have the Council adopt it under Section 16(1) of the Roads (Scotland) Act 1984.

There are specific legal requirements regarding the adoption of a private road (carriageway and / or footway) on to the Council's List of Public Roads.

  1. The road must be a road in terms of the Roads (Scotland) Act 1984
  2. An application for the road adoption must be made by a majority of all of the owners of the land along both sides of the road being offered for adoption.
  3. The road must meet Perth & Kinross Council's standards for adoption

For appropriate standards relating to road construction, carriageway widths, passing and turning provision and minimum visibility standards please refer to the National Roads Development Guide and any variations documents for the Perth and Kinross area.

In the first instance applicants should contact the Planning Team on 01738 476476 to seek advice on the above documents and to discuss the potential adoption of their road.

Responsibility for bringing a road up to an adoptable standard lies with the applicant(s) as do any costs incurred.
